Early Neutral Evaluation

Before the point of no return

Early neutral evaluation is the preliminary assessment of the parties contentions by an independent and impartial person appointed by both parties. The claim is assessed on its facts, evidence and legal arguments by the Neutral Evaluator who then expresses an opinion as to the merits of each party's position.

The process is designed to serve as a basis for further negotiations, or at least help the parties avoid commencing more formal dispute resolution processes. It is a non-binding process that provides an unbiased evaluation of the relative merits of each party's position and gives guidance on the likely outcome should the case proceed further. The evaluation may become binding on the parties if it is not challenged within a specified time period.
